Interferon Cost Lawsuits
Intron / Interferon®
Intron® A or Interferon alfa-2b is an injected medication used in the treatment of chronic Hepatitis B and C. Interferons are a complex family of proteins produced by the body that boost its ability to fight disease. They also can stop viruses from multiplying and damaging the body. Inron A is manufactured by Schering-Plough Corporation.
On May 30, 2003, Schering-Plough announced that its drug-marketing practices, including with respect to Intron® A, were under criminal investigation by the United States Attorney. According to press reports, prosecutors are looking at four key allegations, the company said. These are that Schering Corp. illegally promoted drugs for uses that have not been approved by the Food and Drug Administration, violated laws against paying doctors to prescribe its drugs by distributing free samples and research grants, submitted false drug price information to Medicaid and other federal programs, and destroyed documents to hinder the investigation.
Lieff Cabraser Heimann & Bernstein, LLP, is serving as counsel for patients in lawsuits against prescription drug companies for alleged antitrust and consumer fraud violations. The firm, on behalf of its clients, is investigating whether Schering-Plough manipulated the average wholesale price of Intron® A. The Medicare program uses the average wholesale price to determine the price the government reimburses doctors patients for prescribing drugs. Patients without insurance or paid for a portion of the cost of Intron® A under Medicare may have paid too much because of Schering-Plough’s alleged fraudulently setting of the average wholesale price for Intron® A.
